Guidance for situation that I've got

I would debit it to some sort of temporary Asset account. Such as
Assets:Cash Owed to Me or Assets:Loan or something along those lines.

As an aside... with respect to the claim with the bank, if you're in the
U.S. , an ATM transaction is covered by Reg E which generally requires
provisional credit within about three business days. I'd be surprised if it
takes the whole 45 days for final resolution; the bank is just as
out-of-balance as you are and they (at least at the bank I work at) are
reasonably motivated to get back into balance.
